Terms of Service – Niger Delta DevTrack

Effective Date: July 10, 2025.

1. Acceptance of Terms

By accessing or using the Niger Delta DevTrack platform (“DevTrack,” “we,” “our”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree with any part of these Terms, you must discontinue use immediately. These Terms apply to all visitors, users, and contributors of DevTrack, whether browsing the site or submitting information.

2. Platform Purpose

DevTrack is a non-commercial civic-tech initiative designed to track, monitor, and publish data on public and community development projects in the Niger Delta. The platform also enables whistleblower submissions, stakeholder collaboration, and data-driven reporting by citizens and institutions.

3. Eligibility

You must be at least 18 years old to use this platform, or have the permission of a parent or guardian. By using the site, you represent that you meet this requirement and that all information submitted is accurate and truthful.

4. Content Submission and Use

By submitting any material, including photos, documents, testimonials, reports, or geotagged content, you grant DevTrack a perpetual, royalty-free, non-exclusive license to use, display, publish, adapt, and redistribute such content in furtherance of our public interest mission. You retain ownership of your content but agree not to submit material that is defamatory, false, or infringes third-party rights.

5. Use Restrictions

You agree not to use the platform for unlawful purposes, to disrupt platform operations, or to access data in ways that violate these Terms or applicable law. Scraping, automated queries, impersonation, or attempts to reverse-engineer the platform are strictly prohibited.

6. Accuracy of Information

While DevTrack strives for accuracy in its reporting, we do not guarantee the completeness or correctness of data obtained from third-party or user submissions. You are advised to corroborate findings independently where critical decisions rely on them.

7. Whistleblower Feature

Whistleblowers may submit anonymous reports. Any identifying information provided voluntarily is protected by internal protocols and is never published. We reserve the right to refer credible allegations to investigative partners or public bodies for review.

8. Third-Party Links and Tools

The platform may link to other websites or embed third-party services. DevTrack is not responsible for the content, availability, or legal compliance of these external sources. Your interaction with third-party tools is at your own risk.

9. Modification of Terms

We reserve the right to revise these Terms at any time. Updates will be posted here, and continued use after modifications constitutes acceptance of the new terms.

10. Termination

We may suspend or permanently disable user access for violations of these Terms, misuse of the platform, or upon legal directive. We reserve the right to remove user content that breaches our community standards or legal obligations.

11. Limitation of Liability

DevTrack is provided “as is.” We disclaim all warranties, including implied warranties of fitness for a particular purpose. In no event shall we be liable for damages arising out of or related to your use of the platform, including loss of data, financial losses, or reputational damage.

12. Intellectual Property

All platform content, logos, branding, and visual assets are owned by or licensed to DevTrack. You may not copy, reproduce, or use our intellectual property without express written permission.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of the Federal Republic of Nigeria. Disputes shall be resolved exclusively in the courts of Akwa Ibom State, except where injunctive relief is required elsewhere.
